According to the complaint, Hayes was an invitee at Townfair Plaza located at 475 S. Ben Franklin Road in Indiana, Pennsylvania on July 15, 2024. The lawsuit claims that while lawfully on the premises, Hayes fell due to uneven and defective pavement in the parking lot. This fall resulted in severe injuries including fractured patellae in both legs requiring surgical repair. The plaintiff asserts that these injuries were directly caused by the defendant's negligence in maintaining the property.
The complaint details multiple instances of alleged negligence by Townfair PA Station LLC. It accuses the company of "carelessly and negligently allowing the aforesaid parking lot to be kept in a dangerous condition for a prolonged period of time," failing to inspect and identify defects, and not providing proper safety warnings. Specifically, it is alleged that Townfair PA Station LLC failed to repair or mark the uneven pavement that caused Hayes' injury and did not ensure that the premises could be safely traversed by visitors.
Hayes further contends that he has suffered extensive physical pain, mental anguish, and a severe shock to his nervous system as a result of the incident. He claims ongoing suffering which has impacted his ability to engage in usual activities and will likely continue into the future. Additionally, Hayes asserts that he has incurred significant medical expenses for treatment and may face further financial burdens due to potential loss of earnings and earning power.
The plaintiff is seeking judgment against Townfair PA Station LLC for an amount exceeding $50,000. This sum is intended to cover medical expenses, lost earnings, pain and suffering, and other related damages.
