Parents Sue WellSpan Chambersburg Hospital for Alleged Negligence Leading to Infant’s Death

A tragic case of alleged medical negligence has emerged, involving the death of a premature infant at WellSpan Chambersburg Hospital. The parents of the deceased minor, Adam J. Eichorn and Leah Troup, have filed a complaint against multiple healthcare providers and institutions in York County, Pennsylvania on March 25, 2024.

The plaintiffs, represented by attorneys Kila B. Baldwin, Paola Pearson, and Allison M. Goldberg from Anapol Weiss law firm, accuse Dr. Hyung Woo and other defendants including Dr. Abhimanyu Aggarwal, Dr. Nathan W. Finch, nurses Emily Kerlin and Danyal Simmons, as well as several WellSpan entities of professional negligence leading to the wrongful death of their child F.L.E., who passed away on March 5, 2023.

According to the complaint, Leah Troup was admitted to WellSpan Chambersburg Hospital on March 1, 2023 due to preterm labor at 33 weeks gestation. The infant was born later that day but soon exhibited respiratory distress and was admitted to the NICU. Various complications arose during her stay in the NICU which included issues with umbilical catheter placements by Dr. Woo that were allegedly too deep and misinterpreted by radiologists Drs. Aggarwal and Finch.

The plaintiffs claim that improper placement of an umbilical venous catheter (UVC) led to cardiac tamponade—a life-threatening condition where fluid accumulates around the heart—ultimately causing F.L.E.'s death. They allege that despite clear indications from chest x-rays showing improper UVC placement into the right atrium of F.L.E.’s heart, appropriate actions were not taken by any of the involved medical professionals.

In one critical instance noted in the complaint, despite repeated imaging showing concerning results about UVC placement interpreted by Drs. Aggarwal and Finch as "high" or "indeterminate," there was no urgent communication or corrective action taken to address these findings adequately.

Further accusations include failures in monitoring and responding appropriately during a code event when F.L.E.'s condition deteriorated rapidly on March 5th. The plaintiffs assert that delayed administration of epinephrine during resuscitation efforts worsened her condition leading to irreversible damage.

The plaintiffs are seeking damages for wrongful death under Pennsylvania's Wrongful Death Act (42 Pa.C.S.A §8301) and Survival Act (42 Pa.C.S.A §8302). They demand judgment against all defendants jointly and severally for amounts exceeding local arbitration limits and $50,000 exclusive of interests and costs.
