In a compelling legal battle that underscores the importance of premises safety, Anthony DiGiacomo has filed a lawsuit against Mazaltov Development, LLC and several other parties, alleging negligence leading to severe personal injuries. The complaint was filed on April 4, 2023, in the Court of Common Pleas of Delaware County, Pennsylvania. DiGiacomo claims that Mazaltov Development, LLC and others failed to maintain safe conditions at a property located at 203 Church Road in Morton, PA.
The case revolves around an incident where DiGiacomo reportedly tripped and fell due to deteriorated and uneven sidewalks on the premises. According to the complaint, this fall resulted in "severe and permanent bodily injury," causing significant pain and suffering for DiGiacomo. The plaintiff argues that the defendants were negligent in their duty to maintain safe conditions on their property. The complaint states that the defendants failed in multiple areas: from proper design and maintenance of walkways to failing to warn visitors about potential hazards.
DiGiacomo's legal team highlights numerous allegations against the defendants, including failure to comply with building codes and local ordinances related to property maintenance. Furthermore, they accuse the defendants of neglecting necessary repairs and failing to provide adequate warnings about hazardous conditions. As per the complaint, these oversights led directly to DiGiacomo's injuries.
Seeking justice for his ordeal, DiGiacomo is demanding compensation exceeding $50,000 from each defendant named in the suit. This amount is intended to cover medical expenses incurred due to his injuries as well as future costs related to ongoing treatment. Additionally, he seeks damages for emotional distress and loss of earnings resulting from his inability to work following the accident.
Represented by attorney Marc F. Greenfield from Spear, Greenfield, Richman, Weitz & Taggart P.C., DiGiacomo is pursuing this legal action not only against Mazaltov Development but also Kevin Morrissey doing business as Kevin J. Carpentry; Kevin J. Carpentry LLC; David Valentine; Township of Radnor; and Borough of Morton—all alleged owners or operators responsible for maintaining safety at the location where the incident occurred.
This case will be presided over by judges from Delaware County’s Civil Trial Division under Case ID 03251109-8333-4EA1-A145-9226D682137D.
