The incident occurred on February 3, 2024, when Erica Sager and her husband Terrell Scott were visiting Scott's mother at West Penn Hospital. During their visit, Sager attempted to close the blinds to alleviate discomfort caused by sunlight for her mother-in-law. In doing so, an unsecured metal curtain rod fell from the wall and struck Sager on the forehead. According to the complaint, this resulted in significant injuries including a severe concussion and ongoing symptoms such as migraines and headaches. The plaintiffs allege that hospital staff were aware of the hazardous condition but failed to take corrective action or warn visitors about it.
The lawsuit accuses West Penn Hospital and Allegheny Health Network of negligence and premises liability for failing to maintain safe conditions within the hospital premises. It claims that the defendants did not properly inspect or secure the curtain rod despite knowing its potential danger. The complaint further states that no warnings were provided to visitors regarding this risk. As a result of these alleged failures, Sager has incurred medical expenses and suffered lasting physical and emotional impacts.
In their legal filing, Erica Sager seeks compensatory damages for her injuries along with punitive damages due to what she describes as reckless disregard for safety by the defendants. Her husband Terrell Scott is also seeking damages for loss of consortium, citing deprivation of his wife's companionship due to her injuries.
