Bobbie Widdowson has taken legal action against Midland Credit Management, Inc., alleging violations of the Fair Debt Collection Practices Act (FDCPA). The complaint was filed on January 14, 2025, in the Court of Common Pleas of Allegheny County, Pennsylvania. Widdowson accuses Midland Credit Management of misrepresenting the status of a disputed debt and furnishing false information to credit reporting agencies.
The case began when Midland Credit Management filed a civil complaint against Bobbie Widdowson on October 23, 2024, in Magisterial District Court. In response, Widdowson engaged J.P. Ward & Associates, LLC to defend against these allegations. On November 27, 2024, J.P. Ward & Associates sent a letter to Midland Credit Management disputing the alleged debts and instructing them to cease direct communication with Widdowson. Despite this notice, Midland Credit Management allegedly reported inaccurate information about the disputed debt to TransUnion on December 13, 2024.
According to the complaint, Midland Credit Management falsely represented the character and legal status of the alleged debt by reporting it as "in collection" and "placed for collection," despite knowing it was disputed. This conduct is claimed to violate several provisions of the FDCPA, including sections that prohibit false representations and require communication that a debt is disputed.
Widdowson seeks judgment in their favor along with monetary damages for actual harm suffered due to Midland's actions. They are also pursuing statutory damages under the FDCPA and compensation for attorney fees and costs associated with bringing this action.
