Wendy Davis has filed a lawsuit against the City of Chester, alleging negligence due to hazardous street conditions that led to her injury. The complaint was lodged in the Delaware County Court of Common Pleas on April 14, 2025, with the City of Chester named as the defendant.
The case revolves around an incident on June 25, 2024, when Wendy Davis tripped and fell on a damaged street surface near Central Avenue and Third Street in Chester. According to the complaint, Davis suffered serious injuries from this fall, which she attributes to the city's failure to maintain safe street conditions. The plaintiff claims that the city had a duty to keep its streets free from unreasonable dangers or hazards and failed in this responsibility. "Defendants knew and/or reasonably should have known of the subject damaged, uneven and/or otherwise defective street," states the complaint, highlighting what Davis sees as negligence on part of the city.
