Judgment in car wreck case vacated

PHILADELPHIA – Per a state court judge, a previous motor vehicle accident case judgment has been vacated and a hearing will be held on a motion for partial summary judgment filed by the defendants.

A hearing at Philadelphia City Hall for the Philadelphia County Court of Common Pleas was convened on Tuesday to consider a motion filed by Luong Kim and Dai Pham of Jamison for partial summary judgment, against Keiasha Roland of Philadelphia. The decision to hold this hearing effectively vacated a prior judgment approved in this case on April 16, 2013.

On Sept. 13, 2010 Roland was a passenger in a vehicle driven by fellow Philadelphia resident Dennis Smart. Smart’s vehicle came to the intersection of Broad and Vine Streets, when Kim, operating a vehicle owned by Pham arrived at the same intersection.

According to Roland’s suit, both Smart and Kim engaged in negligent, careless and reckless driving, which caused a collision. Roland asserted in her litigation both Smart and Kim were responsible for speeding, disregarding traffic lanes and inattentive driving.

In the accident, Roland claimed she suffered impairment of bodily function and disfigurement and aggravation of pre-existing conditions, including: disc herniation and bilateral radiculopathy at the junction of L5-S1 (the lumbosacral joint), disc bulges at the junctions of L3 & L4 vertebrae, L4 & L5 vertebrae, and other injuries.

In addition to all injuries and losses, other medical expenses will be incurred in excess of Pennsylvania’s Motor Vehicle Financial Responsibility Law & Workers Compensation Benefits, pursuant to Act 57.

The plaintiff is seeking judgment jointly and severally against all defendants in excess of $50,000, plus attorney’s fees and court costs.

The plaintiff is represented by Marc F. Greenfield, in Philadelphia.

The defendants are represented by K. Reed Haywood of Palmer & Barr and Racheal DeCicco of Snyder, Barrett & Wilkinson, also in Philadelphia.
