PHILADELPHIA – PECO is seeking assistance from the Sheriff’s Office of Philadelphia to settle a payment dispute with a trio of Philadelphia defendants and regain possession of electric equipment property.
On Sept. 4, PECO attorney Angelina C. Williams filed a motion for writ of seizure, seeking to direct the Sheriff’s Office to gain access to an electric meter at a property on West Chew Avenue within 10 days of the order.
It further stipulated the sheriff to contact Williams at least five days in advance, so a PECO representative can repossess the meter, and hire a bonded locksmith to break any locks if access is refused. Williams argued the writ of seizure is necessary for this to occur.
A hearing in this matter was set for Wednesday at Philadelphia City Hall, in Court chambers.
PECO alleges Diana Green Thomas arranged for electric utility services for her residence but failed cover the payments.
As of Aug. 4, PECO estimated Green Thomas owed $4,034.93, and filed a three-count lawsuit - for breach of contract against Green Thomas, for breach of contract against Green Thomas and fellow defendants Carla Thomas and Eugene Dandy, of nearby Chew Avenue, and for claim and delivery of an electric meter valued at $73.00.
PECO asserts it must have access to the property to disconnect electricity without disrupting service to nearby residences and businesses, and that they are entitled to judgment in its favor and possession of the meter.
The plaintiff is seeking the back charges of $4,034.93 plus costs in this case.
The defendants have no legal representation, according to court records.
