ERIE, Pa. -- An Erie County, Pennsylvania couple is suing an area market for injuries alleged suffered by one of the spouses when an employee putting groceries in the trunk of their car slammed the trunk lid against her head.
Frances A. Piazza and Pamela A. Wiley filed the lawsuit against Wegmans Food Markets, Inc. on Sept. 25 in the U.S. District Court for the Western District of Pennsylvania citing negligence, loss of consortium and negligent infliction of emotional distress.
On Oct. 10, 2014, an employee at Wegmans Food Markets in Erie who was putting groceries in the trunk of the couple's vehicle allegedly slammed the trunk lid on Piazza's head as she pointed out an obstruction. Piazza was allegedly knocked unconscious.
Piazza was transported to the hospital and treated for head, back and neck injuries.
Wiley, who was in the car at the time of the incident, allegedly suffered severe emotional distress, which was physically manifested and resulted in severe and ongoing anxiety, headaches and sleeplessness.
The couple is seeking damages, interest, costs of the lawsuit and any other relief authorized by law. They are represented by Richard A. Lanzillo of Knox, McLaughlin, Gornall & Sennett, P.C. in Erie County.
