Man blames Amtrak for injuries allegedly sustained in fall

PHILADELPHIA — An Amtrak employee is suing the company for allegations that he was injured on the job as a result of its negligence.

Kelvalust Terry filed a lawsuit on March 29 in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corporation (Amtrak), citing violations of the Federal Employers’ Liability Act and negligence.

According to the complaint, Terry was employed by Amtrak as a mechanic/machinist on April 21, 2013. The plaintiff claims on that date, he was cutting a wheel set when he tripped on a defect of the platform, causing him to fall down three steps and injure himself. The plaintiff avers that the defendant failed to provide a safe work environment and ostensibly allowed his injuries to be possible through negligence.

Terry seeks damages in the amount of $150,000 and a trial by jury. He is represented by James M. Duckworth of Keller & Goggin PC.
