Defendant in credit card levy case seeking exemption from wage garnishment

PHILADELPHIA – A Philadelphia defendant who is the subject of a credit card balance is seeking exemption from garnishment of wages, executed to recover the entirety of that balance.

Todd Muffler filed a motion claim for exemption on March 22, seeking excusal from garnishment of wages in the amount of $6,090.65, alleging this amount was falsely claimed by the plaintiff. Muffler requested a prompt court hearing to determine the proper exemption amount, and asked that the exemption claim be filed with the Office of the Sheriff of Philadelphia County.

A hearing in this matter was set for this past Thursday in Court chambers, at Philadelphia City Hall.

Plaintiff FIA Card Services alleged Muffler held a credit card from Bank of America (based in Wilmington, Del.) and used this account to purchase goods and merchandise for a due balance of $5,502.17, and has not made a payment on that account since Aug. 9, 2012. Therefore, the plaintiff claims of the defendant the sum of $5,502.17 plus applicable court costs.

Along with the complaint, plaintiff counsel attached documents from Bank of America outlining the due balance amount.

The plaintiff is represented by Frederic I. Weinberg in Conshohocken.

The garnishee is represented by Julie M. Murphy of Stradley Ronon Stevens & Young, in Philadelphia.
