Mechanic sues former employer over alleged wrongful termination

PHILADELPHIA — A former mechanic for Bavarian Specialties Inc. is suing the BMW repair shop over unpaid wage claims.

Nicholas Eby filed a lawsuit on Feb. 22 in the U.S. District Court for the Eastern District of Pennsylvania against Bavarian Specialties Inc. and Michael Yaskin, citing violations of the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment Collection Law.

Bavarian is in the business of servicing and repairing European cars, specifically BMW brand automobiles. According to the complaint, Eby was employed by the defendant as a mechanic from July 2011 through March 2015. During his employment period, the plaintiff claims that he regularly worked in excess of 40 hours per week but allegedly never received overtime compensation from the defendant.

The plaintiff avers that when he complained of his unpaid overtime and put in his two weeks notice, the defendant established a lower hourly rate for the month of March 2015, further violating Pennsylvania wage law.

Eby seeks damages for the unpaid wages, costs, interest, compensatory damages, and punitive damages. He is represented by Edward S. Robson and Joseph N. Frabizzio of Robson & Robson PC, in King of Prussia.
