Shopping center sued for alleged violation of American with Disabilities Act

PHILADELPHIA – A shopping center has been sued for allegedly not making its structure more accessible to handicapped and disabled shoppers.

Owen Harty filed a lawsuit March 31 in the U.S. District Court for the Eastern District of Pennsylvania against Paoli Shopping Center Limited Partnership, Paoli Shopping Center Limited Partnership Phase II and Scartozzi’s Home and Garden Center for allegedly violating the Americans with Disabilities Act.

Harty's allegations include a lack of a compliant, accessible route connecting the disabled parking spaces, long steep ramps without handrails, and a lack of compliant accessible seating and tables, which the suit says makes it difficult or impossible for the handicapped and disabled to dine in the food services areas.

He is seeking that Paoli Shopping Center Limited Partnership make all readily achievable alterations to the property to the extent required by the Americans with Disabilities Act. Harty is being represented by attorney John F. Ward of Thomas B. Bacon, P.A. in Royersford.
