Construction worker blames water park owners for foot injury

PHILADELPHIA — A KP Construction employee blames a foot injury on the owners and operators of Dorney Park and Wildwater Kingdom.

Anthony Dos Santos III filed a lawsuit on April 14 in the U.S. District Court for the Eastern District of Pennsylvania against Cedar Fair LP, Whitewater West Industries Ltd., Orlando Diefenderfer Electrical Contractors Inc., Boyle Construction II Inc., doing business as CC Construction Services, United Rentals (North America) Inc., LR Costanzo Co. Inc., and Neuman Pools Inc., citing negligence.

According to the complaint, Dos Santos was employed by KP Construction to assist in the installation of a waterslide complex at Cedar Fair’s Dorney Park and Wildwater Kingdom.

On April 23, 2014, the plaintiff claims his co-worker was using a forklift to transport a support beam through a narrow area at the park while being guided by the plaintiff. At the same time, a park employee was reportedly operating a 4-wheel ATV and was also attempting to pass through the narrow area. The plaintiff claims the forklift operator ran over his foot as a result of negligence on the defendant’s part, causing him painful and permanent injuries.

Dos Santos seeks compensatory and punitive damages from all parties. He is represented by R. Tyler Tomlinson and Ian S. Abovitz of Stark & Stark PC, in Yardley, PA.
