Man claims he should be getting disability benefits

PHILADELPHIA — A man is suing Life Insurance Company of North America, alleging violation of the Employee Retirement Income Security Act. 

Gregory Webb filed a complaint on July 20 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the insurer improperly denied his claim for disability benefits.

According to the complaint, the plaintiff alleges that in August 2014, he became disabled and was initially paid disability benefits until they were terminated in August 2015. The plaintiff holds the defendant responsible because it allegedly upheld its decision to deny further disability benefits to the plaintiff despite his continuing disability under the terms of the plan.

The plaintiff seeks an award continuing benefits for as long as he remains disabled, all benefits owing to the plaintiff plus interest, court costs and any further relief the court grants. He is represented by Justin C. Frankel and Jason A. Newfield of Frankel & Newfield, P.C. in Garden City, New York.
