PITTSBURGH — An Allegheny County residential real estate company is suing property maintenance company Ashbury Distribution Services Inc. and owner Kelly Morrissey, alleging breach of contract, negligent misrepresentation and negligence.
High Knoll Development Corporation filed a complaint on Nov. 23 in the Court of Common Pleas of Allegheny County against the defendants, alleging that they failed to perform maintenance duties in a workmanlike manner.
According to the complaint, the plaintiff alleges that High Knoll Development Corporation suffered monetary damages and additional costs to repair damages done to properties. The plaintiff holds the defendants responsible for allegedly misrepresenting the quality of their work to the plaintiff.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds the limits of this court plus interest, court costs and any further relief this court grants. The plaintiff is represented by Randal M. Whitlatch and John J. Berry of Dinsmore & Shohl LLP in Pittsburgh.
