PITTSBURGH — A Pennsylvania business is suing Barrette Outdoor Living Inc., an Ohio business, alleging trademark infringement and unfair competition.
CPG International LLC filed a complaint on Jan. 6 in the U.S. District Court for the Western District of Pennsylvania against Barrette Outdoor Living Inc. alleging that the Ohio business causes confusion to the plaintiff's customers by selling products using the same trademark as the ones from the plaintiff.
According to the complaint, the plaintiff alleges that CPG International LLC suffered damages to its business. The plaintiff holds Barrette Outdoor Living Inc. responsible because the defendant allegedly continued to use the plaintiff's trademark despite the plaintiff's demands to cease doing so.
The plaintiff requests a trial by jury and seeks an injunction against the defendant, payment of profits and damages to the plaintiff, an order fpr the destruction of all merchandise advertised under the designations "Premier Railing," court costs and any further relief this court grants.
