Conductor blames New Jersey Transit for attack on platform by man who wanted free ride

PHILADELPHIA – A New Jersey man and train conductor recently began legal action against a major transportation entity, claiming it negligently failed in preventing an assailant from attacking him before a train ride last year.

Vincent John Albanese of Caldwell, N.J,. filed suit on Jan. 19 in the Philadelphia County Court of Common Pleas, against New Jersey Transit Rail Operations of Newark, N.J.

“As a result of the negligence of the defendant, its agents, servants, workmen and/or employees, plaintiff was physically assaulted by an individual located on the platform who wanted to ride to Newark, N.J. for free, causing plaintiff to sustain serious, painful and permanent injuries,” the suit says.

Albanese says the attack took place on Feb. 25, 2016, near New Jersey Transit Train No. 5746 from High Bridge, N.J., to Newark, N.J., and also claims to have sustained multiple abrasions and contusions, post-traumatic stress and multiple cervical spine injuries affecting his C4-C6 vertebrae in the assault.

The plaintiff is seeking damages in excess of $50,000, with no submission to arbitration.

The plaintiff is represented by Robert E. Myers, Lawrence A. Katz and Michael J. Olley of Coffee Kaye Myers & Olley, in Bala Cynwyd.
