Erie woman says she received unwanted called from Fingerhut

PHILADELPHIA — An Erie woman is suing a retailer, citing alleged violation of telephone harassment statutes.

Rita J. Torok filed a complaint on Feb. 1 in the U.S. District Court for the Western District of Pennsylvania against Bluestem Brands Inc., d/b/a Fingerhut, and Does 1-10 alleging that they placed several calls to the plaintiff's cellphone using an automatic telephone dialing system.

According to the complaint, the plaintiff alleges that in September 2016, she sustained damages from receiving several unwanted calls on her cellphone. The plaintiff holds Fingerhut responsible because it allegedly called the plaintiff to collect a debt she allegedly owed.

The plaintiff requests a trial by jury and seeks statutory damages of $500, treble damages and any further relief this court grants. She is represented by Jody B. Burton of Lemberg Law, L.L.C. in Wilton, Connecticut.
