Franklin Collection Service accused of sending threatening letter

PHILADELPHIA — An individual is suing Franklin Collection Service Inc., a debt collector, citing alleged misrepresentation in debt collection.

Yahaira Rivera filed a complaint on Feb. 10, in the U.S. District Court for the Eastern District of Pennsylvania against Franklin Collection Service Inc. alleging that the debt collector sent a collection letter to the plaintiff containing threatening and coercive language.

According to the complaint, the plaintiff alleges that in March 2016, she received a collection letter that contained language that is considered threatening. The plaintiff holds Franklin Collection Service Inc. responsible because the defendant allegedly used abusive language stating that she should settle the debt or contact her attorney for her defense in an attempt to collect from the plaintiff.

The plaintiff seeks actual damages, statutory damages, court costs and any further relief this court grants. She is represented by Antranig Garibian of Garibian Law Offices, P.C. in Philadelphia.
