Cobra Construction, Arizona Designs failed to pay union contributions, labor group says

PHILADELPHIA — A cement workers' union is suing Cobra Construction Company Inc. and Arizona Designs Project Management LLC d/b/a ADPM LLC, citing alleged breach of contract for failing to pay into the labor group's employee funds.

Labor leader Bill Ousey filed a complaint on Feb. 23 in the U.S. District Court for the Eastern District of Pennsylvania on behalf of Cement Masons' Union Local No. 592 and its related funds against the defendants alleging that they failed to make the required monthly payments to the union's pension, welfare and training funds.

According to the complaint, Ousey and the labor group allege that the employees and organizations he represents sustained damages from the unpaid contributions. The plaintiffs hold Cobra Construction and Arizona Designs responsible because they allegedly breached their contractual agreement by failing to remit contributions on behalf of their employees.

The plaintiffs seek judgment against the defendants for the amount of contributions due, audit costs, liquidated damages, interest, court costs and any further relief the court grants. They are represented by Maureen W. Marra of Jennings Sigmond P.C. in Philadelphia.
