Furniture company says Banner Life Insurance, others sent unwanted fax ads

PITTSBURGH — A Pennsylvania corporation has filed a class action lawsuit against Banner Life Insurance Company, William Penn Life Insurance Company of New York, DJM Advisory Group LLC, Donald Quirke and multiple unknown individuals, citing alleged violation of telephone harassment statutes.

Miller's Furniture of Mercer Company d/b/a Haney's Comfort Living Furniture filed a complaint on behalf of similarly situated persons on April 28 in the U.S. District Court for the Western District of Pennsylvania against the defendants alleging that they sent unsolicited fax advertisements to the plaintiff.

According to the complaint, the plaintiff alleges that it sustained damages from receiving unwanted advertisements. The plaintiff holds the defendants responsible because they allegedly sent unsolicited advertisement faxes to the plaintiff.

The plaintiff seeks $500 in statutory damages, court costs, injunction and any further relief this court grants. They are represented by Richard Shenkan of Shenkan Injury Lawyer LLC in New Castle.
