Suit claims State Farm insured was negligent in 2011 Cumberland County crash

SCRANTON — A Virginia couple are suing State Farm Automobile Insurance Company, alleging negligence by its insured driver in a 2011 crash.

William E. Pommerening and Kay W. Pommerening filed a complaint on May 11 in the U.S. District Court for the Middle District of Pennsylvania against State Farm alleging that the insurance company's insured driver failed to stop at a light and struck plaintiff's vehicle in Cumberland County nearly six years ago.

According to the complaint, the plaintiffs allege that they sustained injuries and damage to their vehicle. The plaintiffs holds State Farm responsible because the defendant's insured allegedly failed to keep a proper lookout and stop at a light.

The plaintiffs seek judgment against the defendant in the amount of $150,000 plus interest, delay damages and other damages allowed by law. They are represented by Dean F. Piermattei and Jill Neary Weikert of Pillar Aught LLC in Harrisburg.
