ERIE — A couple are suing Howmedica Osteonics Corporation d/b/a Stryker Orthopaedics, a New Jersey corporation, alleging negligence and and product liability for a faulty hip prosthetic.
David T. Stewart and Donna Stewart filed a complaint on April 28 in U.S. District Court for the Western District of Pennsylvania alleging that the defendant corporation made defective hip implants.
According to the complaint, the plaintiffs allege that they were damaged from David Stewart's being provided a defective hip implant which corroded and caused an infection in 2016. The plaintiffs hold Howmedica Osteonics responsible because the defendant allegedly knew of the defective nature of their implants but failed to take measures to ensure the plaintiffs were not harmed.
The plaintiffs request a trial by jury and seek compensatory damages, special damages, all medical expenses, double or triple damages, court costs, interest and any further relief this court grants. They are represented by Jonathan B. Acklen of Green, Schafle & Gibbs LLC in Philadelphia.
