PHILADELPHIA — A hotel is suing Milestone Hotel Partners LLC, Hershey Hospitality Associates Ltd., Milestone Hershey Management LLC and an unknown owner, alleging they adopted the plaintiff's mark for their hotel location.
Hershey Entertainment & Resorts Company filed a complaint on June 8 in U.S. District Court for the Middle District of Pennsylvania against the defendants alleging that they made use of plaintiff's "Hershey's" mark without permission.
According to the complaint, the plaintiff alleges that its business was damaged from having its mark used without permission. The plaintiff holds the defendants responsible because they allegedly used a similar mark as the plaintiff's to advertise their products and services.
The plaintiff seeks injunction against the defendants from further using plaintiff's trademark, payment for damages, disgorgement, the recall of all infringing products, court costs and any further relief this court grants.
