Lancaster County Public Defender's Office acccused of violating FMLA

PHILADELPHIA — A former assistant public defender is suing the Lancaster County Public Defender's Office, citing an alleged violation of the federal Family and Medical Leave Act.

Matthew Bomberger filed a complaint on June 12 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the Public Defender's Office interfered with Bomberger's FMLA rights.

According to the complaint, the plaintiff alleges that he was financially harmed from being terminated from employment. The plaintiff holds the Public Defender's Office responsible because the defendant allegedly retaliated against Bomberger by terminating his employment for going on an FMLA leave due to an illness.

The plaintiff seeks judgment against the defendant for lost pay, lost bonuses, lost benefits, liquidated damages, court costs, reinstatement and any further relief this court grants. He is represented by Samuel A. Dion of Dion & Goldberger in Philadelphia.
