PHILADELPHIA — A labor group is suing FT Elevator LLC and Donald A. Plancich, citing alleged breach of contract.
Trustees of the National Elevator Industry Health Benefit Plan filed a complaint on June 23 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants failed to remit their employees' contribution.
According to the complaint, the plaintiffs allege that it was damaged financially due to the unpaid contributions. The plaintiff holds the defendants responsible for allegedly breaching their agreement by failing to pay their monthly contribution.
The plaintiff seeks $86,947 in contributions plus interest, $122.62 in contributions due for June 2016, liquidated damages in the amount of $17,410.65, court costs, all contributions and liquidated damages and any further relief this court grants. They are represented by Robert P. Curley and David D. Capuano of O'Donoghue & O'Donoghue LLP in Philadelphia.
