Lebanon Farms Disposal Inc. alleged to have failed to pay drivers overtime wages

SCRANTON – A Grantville man alleges a Schaefferstown waste disposal company fails to properly compensate employees for all hours worked.

Frederick Vanorden filed a complaint on behalf of himself and all others similarly situated on July 25 in the U.S. District Court for the Middle District of Pennsylvania against Lebanon Farms Disposal Inc. citing the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, the plaintiff is employed by the defendant as a driver and routinely works more than 40 hours per week. The plaintiff holds Lebanon Farms Disposal Inc. responsible because the defendant allegedly fails to pay for overtime work at a rate of time-and-one-half of the plaintiff's regular wage rate.

The plaintiff seeks unpaid wages, interest, liquidated damages, court costs and any further relief the court grants. He is represented by Peter Winebrake, R. Andrew Santillo and Mark J. Gottesfeld of Winebrake & Santillo LLC in Dresher.
