Tenant: Ceiling fell on me, left me with post-traumatic headaches

MEDIA – A plaintiff is suing the management and operation companies of his apartment complex for serious injuries he allegedly sustained when his ceiling supposedly collapsed in on him.

Karl LaPorte of Upper Darby filed suit in the Delaware County Court of Common Pleas on July 13 versus Fortjoy Park Lane East, LLC, Fortjoy Development LP and Fortjoy Development II LP, all of Springfield, and Park Lane East Apartments and Fortjoy Development Co, both of Upper Darby.

LaPorte explained he was a tenant at the Park Lane East Apartments in unit D103, pursuant to a rental agreement dated Jan. 26, 2011. According to the lawsuit, LaPorte was in his apartment’s bedroom when the ceiling caved in, striking him about the body and causing him serious injuries.

LaPorte says he suffered a scalp contusion with post-traumatic headaches. Cervical contusion, cervical strain and sprain, post-traumatic myofascial pain, concussion, post-concussive syndrome, shock to the nerves and nervous system, physical pain and mental anguish.

The plaintiff further believes the defendants permitted an improperly-placed and/or negligently-installed ceiling in his apartment; failed to take steps to avoid the ceiling collapse; failed to relocate the plaintiff to another apartment and violated local ordinances relating to the maintenance of rental facilities, among other charges.

For a count of negligence against all defendants, the plaintiff is seeking damages, jointly and severally, in an amount not in excess of $50,000 or the compulsory arbitration limit of the Court.
