PHILADELPHIA – A Chester County consumer claims that two debt collectors made false and deceptive representations in their attempt to collect an alleged debt.
Ruby Abouraya filed a complaint on Aug. 14 in the U.S. District Court for the Eastern District of Pennsylvania against First Advantage Corp. and National Credit Audit Corp. alleging violation of the Federal Debt Collection Practices Act.
According to the complaint, the plaintiff filed for bankruptcy protection in April and included in the bankruptcy schedule was an alleged unsecured debt owed to Kingswood Apartments. She claims the defendants contacted her July 24 and stated that it had verified the debt with the credit bureaus and that her credit would be affected until the balance was paid in full.
The plaintiff holds First Advantage Corp. and National Credit Audit Corp. responsible because the defendants allegedly misrepresented the result of not paying the alleged debt.
The plaintiff requests a trial by jury and seeks award actual and statutory liquidated damages, court cost, interest and any further relief the court grants. She is represented by Richard N. Lipow of Lipow Law Office in Malvern.
