Bayer Healthcare faces suit from Essure users alleging the device migrated

PHILADELPHIA – Several individuals have filed a class action suit over allegations a form of female birth control caused injuries.

Madylyne Bobo, Ema Hernandez, Ronald Hughes, Dawn Carpenter, Richard Carpenter, Odessa Charboneau, Ronnine Hernandez, Cynthia Boyd, et al. filed a complaint on Sept. 5 in the U.S. District Court for the Eastern District of Pennsylvania against Bayer Healthcare Pharmaceuticals Inc. alleging negligence and other counts.

According to the complaint, the plaintiffs were implanted with the defendant's Essure, a female birth control device. They allege the device migrated and fractured, punctured internal organs or caused other injury. The suit states that the device should never have been marketed or sold pursuant to federal law.

The plaintiffs hold Bayer Healthcare Pharmaceuticals Inc. responsible because the defendant allegedly failed to warn the plaintiffs.

The plaintiffs request a trial by jury and seek past and future general damages, economic and special damages, medical expenses, equitable relief, punitive and exemplary damages, court costs, interest and any further relief the court grants.
