SCRANTON – An 87-year-old woman, through her daughter and guardian, has filed a medical malpractice lawsuit against a Wilkes-Barre nursing care facility after she was allegedly dropped by a caregiver.
Della Bednarczyk, by and through her guardian Frances Taylor, filed a complaint on Aug. 1 in the U.S. District Court for the Middle District of Pennsylvania against GGNSC Wilkes-Barre East Mountain LP, doing business as Golden Living Center East Mountain; and GGNSC Wilkes-Barre East Mountain GP alleging negligence and other counts.
According to the complaint, Bednarczyk was admitted to the defendants' facility in February 2011 and needed care for diabetes management and other medical needs. The suit states that on Oct. 1, 2016, a caregiver was attempting to turn the plaintiff while she was in her bed and the mattress slipped, causing the plaintiff to fall on the floor. The suit states the plaintiff suffered femur fractures and a laceration on her face because of the fall.
The plaintiff holds GGNSC Wilkes-Barre East Mountain LP and GGNSC Wilkes-Barre East Mountain GP LLC responsible because the defendants allegedly improperly fastened the mattress to the bed.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount of more than $75,000. She is represented by Jamie J. Anzalone and Kelly M. Ciravolo of Anzalone Law Offices in Wilkes-Barre.
