Northampton Clinic Co. alleged to have failed to reinstate employee after medical leave

EASTON – A former office manager alleges that she was not reinstated to her position by her Easton employer after she returned from a medical leave.

Kathleen Evans filed a complaint on Sept. 21 in the U.S. District Court for the Eastern District of Pennsylvania against Northampton Clinic Co. LLC citing the Family and Medical Leave Act.

According to the complaint, the plaintiff was hired by the defendant's predecessor in 1972 and became an employee of the defendant in 2004 as an office manager. She alleges that in 2016 she went on an eight-week medical leave due to a serious medical condition. She alleges that when she returned from her leave, she was not permitted to return to her prior position or an equivalent position in violation of the FMLA.

The plaintiff requests a trial by jury and seeks injunctive relief, reinstatement to her former position or equivalent with back pay, liquidated damages, court costs and any further relief this court grants. She is represented by David L. Deratzian and Rebecca E. Mitchell of Hahalis & Kounoupis PC in Bethlehem.
