Labor union funds alleged Aria Flooring breached bargaining agreement

HARRISBURG – A Wyoming, Pennsylvania, company is alleged to have failed to pay contributions per a bargaining agreement.

Lester W. Kauffman III, as trustee of the Union Trowel Trades Benefit Funds of Central Pennsylvania; and Thomas Smith, as trustee of the Bricklayers & Stonemasons Local 5 Annuity Fund, filed a complaint on Oct. 26 in the U.S. District Court for the Middle District of Pennsylvania against Aria Flooring citing the Employee Retirement Security Act.

According to the complaint, the plaintiffs allege that the defendant has failed to pay contributions from December 2016 through July 2017 per a bargaining agreement.

The plaintiffs seek any additional contributions due since this action has been filed, liquidated damages, filling fees of $400, service fees in the amount of $137.50, court costs and any further relief as the court grants. They are represented by Charles W. Johnston of Charles W. Johnston PC in Camp Hill.
