ALLENTOWN – A Reading woman alleges her Berks County gymnastics and cheerleading apparel employer did not compensate her for overtime work.
Heather L. Potteiger filed a complaint on Nov. 1 in the U.S. District Court for the Eastern District of Pennsylvania against Elite Sportswear LTD citing the Fair Labor Standards Act and the Pennsylvania Wage Payment and Collection Law.
According to the complaint, the plaintiff alleges that she worked as a full-time assistant marketing manager for the defendant and worked for more than 40 hours per week but was not paid any overtime wages.
The plaintiff holds Elite Sportswear LTD responsible because the defendant allegedly failed to compensate the plaintiff for her overtime work at the legal rate of one-and-one-half times her regular rate of pay.
The plaintiff requests a trial by jury and seeks all unpaid overtime due, all unpaid overtime compensation, liquidated damages equal to 25 percent of plaintiff's unpaid overtime compensation, interest, court costs and any further relief the court grants.
