Sun Life Assurance Co. of Canada alleged to have wrongfully denied benefits

PITTSBURGH – An Avella woman alleges that she has medical evidence to prove her disability and that an insurance company wrongfully denied her benefits.

Jerrie Foltz filed a complaint on Nov. 2 in the U.S. District Court for the Western District of Pennsylvania against Sun Life Assurance Co. of Canada citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled due to a significant medical ailments and applied for long-term disability benefits. The suit states that the defendant denied her claim on July 26.

The plaintiff holds Sun Life Assurance Co. of Canada responsible because the defendant's denial of disability benefits was illegal and unreasonable.

The plaintiff seeks judgment against the defendant in an amount of all benefits due and owing plus interest, court costs and any further relief the court grants. She is represented by Francis M. Moore of Mansmann & Moore LLP in Pittsburgh.
