Greater Pennsylvania Carpenters' Medical Plan trustees allege individuals owe more than $50,000

PITTSBURGH – A medical plan alleges that a Boyers man and a Pittsburgh woman failed to notify it of their divorce.

Board of trustees of the Greater Pennsylvania Carpenters' Medical Plan filed a complaint on Nov. 6 in the U.S. District Court for the Western District of Pennsylvania against William Schwartzmiller and Lisa Schwartzmiller citing the Employee Retirement Income Security Act.

According to the complaint, the defendants were married and divorced in 1992. The suit states William Schwartzmiller was a participant in the plaintiff's plan and Lisa Schwartzmiller was a beneficiary until their divorce.

The plaintiff alleges that the defendants did not notify it of their divorce until February 2017 and that Lisa Schwartzmiller had received coverage from 1992 to 2012 from the plaintiff at a cost of more than $52,000.

The plaintiff alleges it has requested reimbursement from William Schwartzmiller but no payment has been received.

The plaintiff seeks judgment against the defendants for an amount not less than $52,890.78 for medical and prescription/coverage provided, interest, court costs and any further relief this court grants. It is represented by Stephen J. O'Brien and Andrew L. Ciganek of Stephen J. O’Brien & Associates in Pittsburgh.
