Spec-Tech-Sales Inc. alleges Harsco Industrial breached contract

HARRISBURG – A Colorado corporation alleges a Pennsylvania company and Montana company damaged it via a breach of contract.

Spec-Tech-Sales Inc. filed a complaint on Nov. 8 in the U.S. District Court for the Middle District of Pennsylvania against Harsco Corp., doing business as Harsco Industrial Patterson-Kelley, and Clapper Co. alleging breach of contract and other counts.

According to the complaint, the plaintiff is an independent representative of HarscoPK in Wyoming. It alleges that HarscoPK breached the agreement between it and the plaintiff by allowing a competing representative to sell in the plaintiff's exclusive territory. The plaintiff alleges Clapper directed sales orders that damaged it to Pennsylvania.

The plaintiff seeks full amount of its damages, punitive damages, court costs and other expenses of litigation, and any further relief this court grants. It is represented by Stephen Moniak of Pillar Aught LLC in Harrisburg.
