PITTSBURGH – A plaintiff injured in a shopping center pharmacy’s parking lot has initiated litigation against the parties she believes are responsible for her severe lung and skull injuries.
Anna Baldinger of Bethel Park filed suit in the Allegheny County Court of Common Pleas on Dec. 11 versus Giant Eagle, Inc. and Bethel Park, LLC, also all of Bethel Park.
On Aug. 28, Baldinger claims she was injured by a depression/hole located on the Giant Eagle parking lot’s asphalt surface, which constituted a dangerous condition that caused her serious and permanent personal injuries.
Baldinger alleges she sustained lung injuries including one to her pneumothorax, closed-head injuries, scrapes, lacerations, contusions and bruising in the accident, all of which caused her permanent scarring and disfigurement.
Per Baldinger’s complaint, the defendants failed to design, construct, maintain and/or repair the mentioned areas on the premises, warn of the aforementioned dangerous condition and failed to erect barricades and/or block off the area in question, among several other charges.
For a lone count of negligence, the plaintiff is seeking damages in excess of $35,000, plus all costs and other relief the Court deems just.
The plaintiff is represented by Marc I. Simon of Simon & Simon, in Pittsburgh.
