PHILADELPHIA – Two former servers at a Philadelphia restaurant allege they were not paid a minimum wage or for overtime work.
Tiara Scotland and Janaya Outerbridge filed a complaint on behalf of themselves and others similarly situated on Dec. 11 in the U.S. District Court for the Eastern District of Pennsylvania against SH Restaurant Inc., doing business as Cedar Park Cafe, alleging violation of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.
According to the complaint, the plaintiffs worked for the defendant as servers. They allege the defendant's policy was to rely solely on tips to compensate tipped employees.
The plaintiffs hold SH Restaurant Inc. responsible because the defendant allegedly failed to pay minimum wages and overtime wages for hours worked that exceeds 40 hours per week.
The plaintiffs request a trial by jury and seek unpaid minimum wages and overtime compensation, court costs, interest, incentive award, and any further relief the court grants. They are represented by Jason T. Brown of JTB Law Group LLC in Jersey City, New Jersey.
