Story Shares claims Jabico blocked access to plaintiff's website

MEDIA — A nonprofit company is suing a business development service company, citing alleged breach of contract, tortious interference and unjust enrichment.

Story Share Inc. filed a complaint May 16 in the Delaware County Court of Common Pleas against Jabico Enterprises Inc. and Gary Herman, alleging that the defendants deprived Story Shares of the use of its property and obstructed Story Shares' ability to advance its charitable purpose.

According to the complaint, Story Share hired the defendants in 2013 to develop a website that promotes the writing and distribution of reading materials to struggling young readers. However, the plaintiff claims the defendants created a code that controls access to the website's administrative dashboard. 

As a result, Story Share claimed it cannot access the dashboard and its staff does not know how many books are waiting to be published, even though Story Share owns the site and paid the defendants large sums of money to create it. 

The plaintiff said the defendants allegedly have purposely blocked Story Share's staff's access to the administrative functions of the website, knowing that the Story Share would be unable to access the books in the digital library.

The plaintiff requests a trial by jury and seeks judgment in an amount to be determined. Story Share is also asking the court to order the defendant to restore administrative access to the website and G Suite account. The plaintiff is represented by Jessica M. Anthony and Matthew I. Vahey of Ballard Spahr LLP in Philadelphia.
