Couple claim Veterans Affairs failed to diagnose medical condition

ERIE — A couple are suing a government agency, citing alleged medical negligence and loss of consortium.

Lucian Weese and Jennifer Weese filed a complaint on Oct. 5 in the U.S. District Court for the Western District of Pennsylvania against the Department of Veterans Affairs, alleging violation of the Federal Tort Claims Act.

According to the complaint, on Nov. 24, 2015, after undergoing surgery by the defendant, Lucian Weese allegedly suffered injuries as he continued to exhibit unmistakable symptoms of bilateral RLN nerve palsy and paralysis and its sequela. 

Furthermore, Lucian Weese says he developed worsening dyspnea on exertion, dysphonia and stridor. As a result, Lucian Weese is unable to return to work and his condition is likely permanent, causing for Jennifer Weese to lose to support of her husband, the suit says.

The plaintiffs hold the Department of Veterans Affairs responsible because the defendant allegedly failed to know and/or utilize accepted and proper principles of history -- taking in the care and treatment provided to plaintiff and failed to exercise reasonable care and judgment.

The plaintiffs request a trial by jury and seek judgment in the sum of $5 million plus prejudgment interest, attorney's fees, costs expended, and such other relief as the court deems necessary and just. They are represented by Michael George of Law Office of Michael C. George in Pittsburgh.
