Drexel University, Chester County construction group settle case with plaintiff who alleged foot injuries were their fault

PHILADELPHIA – A plaintiff who alleged in Philadelphia state court that she suffered a broken right foot due to negligence on the part of a Chester County construction company and Philadelphia’s Drexel University has settled her case.

On July 15, defense counsel member Thomas E. Tyler filed a praecipe to settle, discontinue and end litigation filed by plaintiff Sophia Gartland, to all parties. Terms of the settlement were not revealed.

Gartland, of Westmont, N.J., first filed suit in the Philadelphia County Court of Common Pleas on May 22, 2018 versus Chesco Coring and Cutting, Inc. of Malvern and Drexel University, of Philadelphia.

On July 12, 2016, Gartland was lawfully traversing the sidewalk at the property located in the 3400 block of Lancaster Walk on the campus of Drexel University, where she was caused to trip and fall over wires, hoses and other dangerous conditions placed on the walkway by Chesco Core and Cutting for construction purposes, resulting in multiple injuries, the suit said.

Gartland claimed to have suffered a fracture of her right foot (to the fifth metatarsal) and surrounding body parts – and that the defendants failed to inspect the area, to cure the material defect or to use proper materials, in addition to other allegations.

Prior to settlement and for negligence, the plaintiff was seeking damages, singularly, jointly and severally, not in excess of $50,000.

The plaintiff was represented by David B. Sherman of Solomon Sherman & Gabay, in Philadelphia.

The defendants were represented by Thomas E. Tyler of Davis Parry & Tyler in Philadelphia, Jonathan K. Hollin of Brehm Nofer & McCarter in Conshohocken and Elizabeth G. Gee of Tanenbaum Keale, in Malvern.
