PHILADELPHIA – The case of a Philadelphia woman who claimed an ambulance company’s personnel responsible for attending to her father in a medical emergency caused him fatal injury has been settled, according to court records.
According to a June 24 announcement from Philadelphia County Court of Common Pleas Judge Karen Shreeves-Johns, Cindia Bost’s action against Rhythm Ambulance, Inc. was settled after assignment for trial and before a jury could be selected.
Bost, Administrator of the Estate of James Ryals [deceased], of Philadelphia first filed suit in the Philadelphia County Court of Common Pleas on June 20, 2017 against Rhythm Ambulance, Inc., of Bensalem.
“On or about Nov. 25, 2015, plaintiff’s decedent was being transported by defendant’s agent, servant, workman, or employee when defendant’s employee’s carelessness and negligence caused the plaintiff to fall and strike his head and cause serious and fatal personal injuries, on account of which this action is brought,” the complaint said.
“On or about Aug. 29, 2016, plaintiff, [Cindia] Bost, was appointed the Administrator of the Estate of James Ryals, decedent, by the Register of Probate and Wills and Grant of Letters Testamentary and of Administration, in and for the County of Philadelphia,” the complaint added.
Per the lawsuit, Bost invoked Pennsylvania’s Wrongful Death and Survival Action to recover damages incurred due to the aforementioned events.
Before settlement and for counts of negligence, wrongful death and survival, the plaintiff is seeking damages in excess of $50,000, plus costs and other relief the Court deems necessary in this matter.
The plaintiff was represented by Marc I. Simon of Simon & Simon, in Philadelphia.
The defendants were represented by Ryan F. Michaleski and Lawrence D. Jackson of Lewis Brisbois Bisgaard & Smith, in Wayne.
