PITTSBURGH – The Scenery Hill family of a 23-year-old man who was killed when he was hit in the head by a piece of heavy equipment while working on a pipe-drilling project is seeking damages from the company that oversaw the project and others.
Joseph McCloskey and Judith McCloskey, individually and as administrators of the estate of Ty McCloskey, filed a complaint Dec. 2 in the Court of Common Pleas of Allegheny County against SDI Gas LLC, Shaft Drillers International LLC, CPV Energy Center and others alleging negligence and wrongful death.
The suit states Ty McCloskey was working on Oct. 4, 2018, on a pipe-drilling project in Cambria County being performed by SDI, Shaft Drillers and/or North American Directional LLC. According to the suit, the project involved the use of a set wrench that was 40 inches long and weighed 65 pounds to push pipes into the ground.
While McCloskey was setting the wrench on one of the pipes, it began to spin, struck him on the head and caused fatal injuries, the suit states.
The plaintiffs allege the defendants failed to adequately ensure the safety of the worksite and failed to provide the decedent with a safe place to work.
The plaintiffs seek compensatory damages of more than $50,000, interest and all other just relief. They are represented by Larry Bendesky, Adam Pantano, Robert Zimmerman and Scott Fellmeth of z, Mongeluzzi, Barrett and Bendesky of Philadelphia and Christopher Heavens of Heavens Law Firm PLLC in Boothwyn.
