Towing fee class actions leave convenience stores asking for insurance money

PITTSBURGH — The operators of several Pittsburgh convenience stores are alleging Great Northern Insurance refuses to defend them in class action lawsuits in breach of their insurance policies. 

CoGo's Co., Realty Income Corporation, Sonya and Zoran Lazarevic and Sylvia Duda filed a complaint April 17 in the Court of Common Pleas of Allegheny County against Great Northern Insurance Company and others, alleging breach of contract and bad faith. 

CoGo's has a $4 million general liability insurance policy with Great Northern. CoGo's alleges that Great Northern has failed to defend it in two consumer class actions in which the claimants seek to hold them responsible for alleged excessive fees charged by the towing company they used to remove unauthorized vehicles from their convenience store parking lots.

CoGo's seeks monetary relief, trial by jury and all other appropriate relief. They are represented by Brian Lipkin of Babst, Calland, Clements and Zomnir PC in Pittsburgh.
