Tripping hazard in Viewmont Mall Mexican eatery leads to damages request

SCRANTON - A Mexican restaurant in the Scranton Viewmont Mall faces a personal injury payout after a Peckville woman says she was injured tripping on the restaurant's doormat, according to documents filed March 1 in the Lackawanna County Court of Common Pleas. 

Plaintiff Ann Marie Kolcharno visited La Tonalteca in August 2019 with her husband, when she allegedly tripped over an old, dilapidated doormat with edges that did not lay flat at the restaurant's front entry. 

The lawsuit says that the condition of the mat and the tripping hazard are not made immediately aware to guests of the restaurant. 

As a result, Kolcharno complains that she fractured a lower extremity, suffered many head lacerations and aggravated preexisting conditions.

La Tonalteca is sued for one count of negligence from the plaintiff, and one count of loss of consortium from her spouse, seeking more than $50,000 in restitution for each. 

Kolcharno is represented by Matthew Dempsey of Lenahan and Demspey PC.
