MEDIA — A couple have filed a lawsuit against The Giant Company after the husband allegedly slipped on apple sauce and suffered injures at its grocery store in Landsdowne.
Opara J. Onyeachu and Harriet Onyeachu filed a complaint June 28 in the Court of Common Pleas of Delaware County against The Giant Company LLC.
According to the Onyeachus' complaint, Opara Onyeachu was walking near the checkout lanes at the Giant Food Store on East Baltimore Avenue in Landsdowne on Nov. 17, 2019. They allege he slipped on "a substance later described to him by employees" as apple sauce and suffered injuries to his head, neck, shoulders, spine and other parts of his body.
The plaintiffs claim that Giant had "constructive and/or actual notice" of the apple sauce on the floor which was "inherently dangerous" and caused a slip and fall. They further claim Giant failed to have warning signs or barriers in the area to alert or warn of the dangerous condition and to inspect and maintain their store with "reasonable care."
The plaintiffs seek monetary relief of more than $50,000, interest and all other just relief. They are represented by attorney Mark Kirby.
