LANCASTER — A man is suing a commercial property owner for not having snow guards on its metal roof, which allegedly caused heavy snow to damage his classic Chevrolet automobile that was parked in a nearby property.
Patrick Fetterman filed a complaint July 7 in the Court of Common Pleas of Lancaster County against Muser Properties LLC, alleging negligence.
Fetterman owns a 1950 Chevrolet Deluxe Special classic automobile that was being restored and parked at a property that abuts the western border of the defendant's parcel on East Main Street in New Holland, according to his complaint.
He alleges that on Dec. 18, 2020, "a substantial amount of snow" slid off a portion of the defendant's property and fell directly onto his classic Chevrolet. Fetterman further alleges the "impact and weight" of the snow damaged his car's paint, body and frame and caused the need for "substantial repairs."
He claims the defendant negligently failed to install snow guards on its sloped metal roof and that seven days after the incident, the defendant's employees were seen installing the snow guards. Fetterman alleges he has spent $14,813.50 worth of repairs to fix the damage to his classic car and incurred a storage charge of $1,335.60.
Fetterman seeks monetary relief of at least $16,209.10 and all other proper relief. He is represented by Patrick Deibler of Kling & Deibler LLP in New Holland.
