Customer alleges defective shopping cart caused his fall, fractured hip at Shop N Save

PITTSBURGH — A Shop N Save customer allegedly suffered a fractured hip and other injuries due to an alleged defective shopping cart. 

Gus Mantalais and Rose Mantalais filed a complaint in the Court of Common Pleas of Allegheny County against Duritza Properties LP and Duritza's Enterprises Inc., doing business as Shop N Save alleging negligence. 

Gus Mantalais was at the Shop N Save on West Pike Street in Canonsburg on Nov. 28, 2019, according to the plaintiffs' suit. They allege that Gus Mantalais was pushing a shopping cart when exiting the store when the wheels of the cart suddenly locked up and stopped abruptly.

The plaintiffs claim Mantalais was thrown to the asphalt surface of the parking lot and suffered a fractured hip, bruises, sprains as well as injuries to his muscles, tendons, ligaments and other parts of his body. They allege the defendants' negligence for allowing the dangerous condition to exist and failed to warn of the hazardous and defective condition of the shopping cart that was on its premises. The plaintiffs also claim the defendants failed to inspect, maintain and repair its shopping carts. 

The plaintiffs seek monetary relief, interest and all other just relief. They are represented by G. Christopher Apessos of Apessos Law LLC in Pittsburgh.
